A First Circuit panel upheld Wynn Resorts’ use of coinless self-serve machines that don’t pay out the full value of slot machine redemption tickets, finding that it doesn’t constitute an unfair or deceptive business practice.
A. Richard Schuster filed a class action suit in Massachusetts state court challenging the use of 28 coinless kiosks at the Encore Boston Harbor Casino, which dispense bills and additional redemption tickets for the remaining value in cents. He argued that the practice departed from Wynn’s internal controls—and thus government and industry regulations—that provide the kiosks had to dispense the “appropriate amount of funds.”
